By accessing or using the free Google Business Profile Audit tool (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service. The Service is operated by Upscale Marketing ("we", "us", or "our").
Description of the service
The Service provides an automated analysis of publicly available Google Business Profile data for US businesses. You enter a business name and select a result from the Google Places suggestions. We then generate a score and report based on publicly visible profile signals.
The audit is provided for informational and marketing purposes only. It does not guarantee any specific search ranking, traffic increase, or business outcome.
User information and conduct
You may use the Service to audit your own business or a business you are authorized to evaluate. You agree not to:
- Use the Service for unlawful purposes or to violate any applicable law.
- Attempt to interfere with the operation of the Service or its underlying systems.
- Scrape, reverse-engineer, or automate access to the Service beyond normal use.
- Submit false or misleading information through any form.
We may suspend or restrict access to anyone who violates these rules or uses the Service in a way that could harm us or other users.
Intellectual property
All content, branding, reports, and materials generated by the Service are owned by Upscale Marketing or its licensors, unless otherwise stated. You may view, download, and share your individual audit report for your own business purposes. You may not resell, republish, or systematically reproduce reports or site content without our written permission.
Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, completeness, reliability, or timeliness of the audit reports. The audit relies on third-party data sources (such as Google Places and Google Maps) that we do not control, and those sources may contain errors or become unavailable.
Any action you take based on the audit report is at your own discretion and risk. We recommend confirming important facts independently before making business decisions.
Limitation of liability
To the fullest extent permitted by law, Upscale Marketing and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption, arising out of or related to your use of the Service, even if advised of the possibility of such damages.
Our total liability for any claim arising from the Service will not exceed the amount, if any, you paid to use the Service. The Service is free of charge, so this limitation may result in no monetary recovery.
Indemnification
You agree to indemnify and hold harmless Upscale Marketing from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Florida.

We may update these Terms of Service from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Service after changes are posted means you accept the updated terms.
